Why is the Alameda County Court after Walter Hoye? Is it Justice they seek or protection of the Abortion Industry?

Greetings Everyone ... Here's and update on this ongoing Court effort.

I was arrested on Tuesday, May 13th, 2008 for allegedly violating Oakland's new "bubble" law (8.52 ACCESS TO REPRODUCTIVE HEALTH CARE FACILITIES). I've often been at the site Family Planning Specialists Medical Group 200 Webster Street Suite 100, 94607 510-268-3720, Oakland, CA., carrying a 40-inch sign that read, "Jesus Loves You & Your Baby. Let Us Help You," and attempting to hand out pro-life literature. On May 13th I was charged not only with approaching a patient without consent, but also with two separate counts of using "force, threat of force, or physical obstruction" to injure or intimidate two abortion clinic escorts.

Yesterday, (12/12/2008), the Assistant District Attorney of Alameda County admitted that the case against me was less than ideal. He has no victim. He has no undercover police as witnesses. He has angry white abortion clinic escorts and he has angry white abortion clinic owners pressing for a conviction against me a Pro-Life black minister.

Ordinarily, the assistant D.A. would have the authority to handle the case anyway he wanted to. However, in my case he does not seem to have any authority to do this. It appears he must get approval from superiors regarding any decision in my case. It appears that those "above the prosecutor" have an unusual interest in my case in order to get the new "bubble law" in Oakland, California legitimized so sidewalk counseling, pro life information, and saving of unborn babies is stopped.

I was offered a "plea bargain" of no jail time (since I do not have a criminal record) if I would plead guilty to the charges against me and would permanently "stay away" from the abortion clinic Family Planning Specialists Medical Group 200 Webster Street Suite 100, 94607 510-268-3720, Oakland, CA. Of course the offer was unacceptable and I rejected it. This is what my attorney had to say about it. “The district attorney’s office appears to be using these trumped-up charges as leverage to pressure Rev. Hoye into giving up his free speech rights,” said Hoye’s attorney Mike Millen. “The threat of four years in jail is a potent one, but my client is more interested in getting the truth out, both on the sidewalk and in the courtroom.”

So, I am headed for a jury trial. I am scheduled to be in court Friday, December 19th, 2008 at 9:00 A.M., in Department 111 at the Wiley W. Manuel Courthouse 661 Washington Street, Oakland, CA 94607, for a "readiness hearing". Its a hearing in front of a judge where all parties decide if the case is going to trial, or some plea bargain reached. Often times, the "readiness hearing" will be continued until all parties are ready to start the trial. When all the parties are ready for trial, the judge will assign a date and time to begin.

The out come is uncertain at this time. At this County court if I am found guilty, I will be facing penalties of jail time in the Alameda county jail for up to one year and/or a fine of $2,000. I guess I'm learning a little bit about how Martin Luther King felt as he faced the same legal forces and uncertainties during the early days of the civil rights movement.

While in court I do feel a sense of peace that comes from the prayers of the saints of God. My wife and I are grateful for your love and support.
